Terms of Service
These Terms of Service govern access to and use of the public website at margynx.com and the Agentix Seller Cockpit service provided by Margynx.
1. Acceptance of terms
By accessing or using the service, you agree to these Terms. If you use the service on behalf of an organization, you represent that you have authority to bind that organization.
2. The service
Agentix Seller Cockpit is a software service for analytics, monitoring, repricing-related workflows, and operational decision support for Amazon sellers. Some functionality depends on seller authorization, data availability, third-party systems, and factors outside Margynx’s direct control.
3. Accounts and security
- You must provide accurate information and keep it reasonably current.
- You are responsible for safeguarding your credentials and for activities that occur under your account, except to the extent caused by Margynx.
- You must promptly notify Margynx of suspected unauthorized access or security issues involving your account.
4. Customer data and permissions
- You represent that you have the right to provide or authorize access to any data made available through the service.
- You remain responsible for complying with applicable laws, marketplace rules, and Amazon requirements that apply to your own business.
- You may revoke Amazon authorization at any time through Amazon’s controls, although doing so may disable parts of the service.
5. Acceptable use
You may not use the service to violate law, infringe rights, interfere with the service, bypass security controls, introduce malicious code, or misuse the service to build a competing product from non-public service materials.
6. Fees and billing
Paid plans, billing terms, and any additional commercial terms will be provided at the time of purchase or in a separate commercial agreement. Unless stated otherwise, fees are non-refundable except where required by law.
7. Intellectual property
Margynx and its licensors retain all rights, title, and interest in the service, software, interfaces, branding, and related materials, excluding customer data. Subject to these Terms and any commercial agreement, Margynx grants you a limited, non-exclusive, non-transferable right to use the service during the applicable term.
8. Feedback
If you provide feedback or suggestions, Margynx may use them without restriction, provided such use does not disclose your confidential information in a way not otherwise permitted.
9. Disclaimers
- The service is provided on an “as is” and “as available” basis.
- Margynx does not guarantee uninterrupted availability or specific business outcomes such as Buy Box wins, sales growth, or margin expansion.
- Outputs, recommendations, and automation features are decision-support tools and do not constitute legal, tax, accounting, or other professional advice.
- You remain responsible for reviewing and controlling how the service is used in your own business context.
10. Limitation of liability
To the maximum extent permitted by law, Margynx and its affiliates, personnel, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, business opportunities, or interruption. To the maximum extent permitted by law, aggregate liability arising out of or relating to the service will not exceed the amounts paid by the customer to Margynx for the service during the twelve months preceding the event giving rise to the claim.
11. Suspension and termination
Margynx may suspend or terminate access for material breach, non-payment, security risk, legal compliance reasons, or misuse of the service. You may stop using the service at any time, subject to any contractual minimum term that may apply under a separate commercial agreement.
12. Changes
Margynx may update these Terms from time to time. Continued use of the service after an updated version becomes effective constitutes acceptance of the updated Terms.
13. Governing law
This section should be finalized to match the actual legal entity, governing law, dispute process, and contracting posture used by Margynx before production deployment.
